Terms and Conditions – BeeApp
1. Introduction
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Buyer,” “Vendor,” or “Reseller”) and BeeApp (“BeeApp,” “we,” “us,” or “our”), governing your access to and use of the BeeApp mobile application, website, and associated services (collectively, the “Platform”). By accessing, registering, or using BeeApp in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform. These Terms supersede any prior agreements or understandings relating to your use of BeeApp.
2. Legal Capacity and Eligibility
Use of BeeApp is strictly limited to individuals who are at least 18 years of age and legally capable of entering into binding agreements under the applicable laws of Pakistan. By using BeeApp, you represent and warrant that you have the legal capacity to contract and that you are not barred from using the Platform under any applicable law or regulation. BeeApp reserves the right to suspend or terminate access if we reasonably believe that eligibility requirements are not satisfied.
3. Nature of Services
BeeApp functions solely as a digital intermediary and technology platform. We do not manufacture, own, or directly sell any products listed on the Platform. All products are listed, owned, and sold by independent third-party vendors, and all transactions are contracts entered into directly between vendors and buyers. BeeApp merely provides the technological means for connecting parties, facilitating orders, and processing payments. By using the Platform, you acknowledge that BeeApp is not and shall not be deemed to be a seller, agent, guarantor, or insurer of any product or service offered.
4. Verification and “Verified Tag” Disclaimer
BeeApp may, in its discretion, assign a “Verified” tag to certain vendors or products based on limited background checks or assessments performed at a given point in time. This verification process is designed only to provide users with indicative confidence but does not, under any circumstance, constitute a warranty, guarantee, representation, or assurance by BeeApp as to the authenticity, legality, safety, or quality of products or vendors. The absence of a “Verified” tag equally does not imply unreliability. All legal responsibility for product compliance, authenticity, and safety rests solely with the vendor.
5. User Obligations and Prohibited Conduct
All users are strictly required to use the Platform in compliance with applicable laws and regulations. Vendors shall ensure that their product listings are accurate, lawful, and not misleading. Vendors must not list counterfeit, stolen, hazardous, or otherwise prohibited goods. Vendors are legally responsible for all claims, disputes, and liabilities arising from their listings and transactions. Buyers, in turn, are responsible for providing accurate delivery details, timely acceptance of deliveries, and lawful use of purchased items. Fraudulent behavior, abusive activity, misrepresentation, infringement of intellectual property rights, or any other unlawful conduct is strictly prohibited and may result in immediate suspension, termination, or legal action.
6. Content and Intellectual Property Rights
Users may upload product images, descriptions, logos, or other content (“User Content”). By submitting such content, you grant BeeApp a worldwide, royalty-free, non-exclusive license to use, reproduce, display, distribute, and adapt such content solely for the operation of the Platform. You represent and warrant that you have full ownership or legal rights to the User Content and that it does not infringe the rights of any third party. All intellectual property rights in the BeeApp name, trademarks, software, design, layout, and branding remain exclusively with BeeApp and may not be copied, used, or exploited without express written consent.
7. Transactions, Payments, and Payouts
BeeApp facilitates payment collection on behalf of vendors but is not a contracting party to the transaction between buyer and vendor. Payments made through the Platform will be held and processed in accordance with BeeApp’s payout policies. Vendors are solely responsible for fulfilling orders, shipping products, and providing refunds in line with their declared policies and applicable law. BeeApp acts only as a payment intermediary and does not guarantee successful completion of transactions. By transacting through BeeApp, both buyers and vendors acknowledge that BeeApp shall bear no liability for delivery failures, delays, defective products, or disputes arising from the underlying sales contract.
8. Returns, Refunds, and Dispute Resolution
Any return, exchange, or refund is a matter strictly between the vendor and buyer, subject to the vendor’s policy and applicable consumer laws. BeeApp does not offer or guarantee refunds, returns, or exchanges. In the event of disputes, buyers must approach the vendor directly. While BeeApp may, at its discretion, offer limited support to mediate disputes, such involvement shall not constitute acceptance of liability. By using the Platform, you agree to release BeeApp from any claims, damages, or demands arising from disputes between buyers and vendors.
9. Limitation of Liability
To the fullest extent permitted by law, BeeApp disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for purpose, or non-infringement. BeeApp shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the Platform, including but not limited to damages for product defects, loss of profits, data breaches, service interruptions, or delays. Vendors remain solely liable for all obligations arising from their transactions, and buyers acknowledge that BeeApp bears no liability for the safety, legality, or performance of products purchased.
10. Account Suspension and Termination
BeeApp reserves the right to suspend, restrict, or permanently terminate user accounts without prior notice if, in its sole discretion, the user is found to be in violation of these Terms, engaged in unlawful activity, or acting in a manner detrimental to the integrity of the Platform. Users may voluntarily terminate their accounts by discontinuing use of the Platform. Upon termination, any pending obligations between buyer and vendor shall remain enforceable without affecting BeeApp’s disclaimers and limitations of liability.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any dispute, claim, or legal proceeding arising out of or relating to these Terms or the use of the BeeApp Platform shall be subject to the exclusive jurisdiction of the competent courts located in Faisalabad, Pakistan.
12. Amendments and Modifications
BeeApp reserves the right to update, amend, or revise these Terms at any time without prior notice. Any modifications shall take effect immediately upon publication on the BeeApp website or application. Continued use of the Platform after such updates constitutes acceptance of the revised Terms. Users are encouraged to review these Terms periodically to stay informed of their rights and obligations.
